The agreement between you and BenchK LLC when you buy from us. Please read it — placing an order means you accept these terms.

These terms govern your purchase from BenchK LLC (“BenchK,” “we,” “us”) through this website. By placing an order you confirm you are at least 18, that the information you provide is accurate, and that you accept these terms and our Privacy Policy.
By placing an order you agree to pay the listed price plus any applicable tax. Free shipping applies to the continental U.S. only; Alaska, Hawaii, and U.S. territories are quoted separately. Your order is an offer to buy; a confirmation email acknowledges receipt but is not acceptance — a contract forms only when we ship the item.
Pricing errors.Despite our best efforts, a product may occasionally be mispriced or described inaccurately. If an item’s correct price is higher than the price shown, we may, at our discretion, cancel the order (and refund any payment) or contact you for instructions before shipping. We are not obligated to honor an obviously erroneous price.
BenchK equipment is rated to a 330 lb (150 kg) user load. Use it within the rated capacity, in accordance with the mounting instructions, and only on approved wall substrates (solid masonry, or a stud wall with the correct WHB+S8 / WH1+S4 holder). Drywall / plasterboard alone is not a viable substrate. Improper installation, modification, or overload voids the warranty and may cause serious injury.
BenchK provides a limited warranty of 10 years on metal frame elements and 2 years on wood, polyurethane, and other components, against defects in materials and workmanship under normal use. It does not cover damage from improper installation, overload, modification, accident, or normal wear. Returns and refunds are handled per our Shipping & Returns policy.
Except for this express limited warranty, and to the fullest extent permitted by law, the products are provided “as is” and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Nothing here limits any non-waivable rights you have under the Magnuson-Moss Warranty Act or other applicable consumer-protection law.
To the fullest extent permitted by law, BenchK’s total liability arising out of or related to your purchase is limited to the amount you paid for the product. We are not liable for indirect, incidental, or consequential damages arising from the use or installation of the product. This does not affect statutory rights that cannot be waived.
The BenchK name, logo, product designs, photography, and site content are the property of BenchK LLC or its licensors and may not be copied or used without permission.
We’d rather solve any problem directly — email biuro@benchk.com first. If we can’t resolve it, you and BenchK agree that disputes will be resolved by binding individual arbitration rather than in court, and each party waives any right to participate in a class action, except that either party may bring a qualifying claim in small- claims court. You may opt out of this arbitration agreement within 30 days of your first order by emailing us. Some jurisdictions do not allow this; where prohibited, it does not apply to you.
These terms are governed by the laws of the State of Florida, U.S.A. To the extent a dispute proceeds in court, it will be resolved in the courts of Pinellas County, Florida, unless otherwise required by law.
